Is consent of the person to be background checked needed to legally order a background check for employment purposes?

The FCRA along with certain state laws require employers to obtain written or electronic consent of the person to be checked prior to conducting the check and to make certain disclosures to that applicant. The FCRA also requires that disclosures and consent be on a form separate from the job application. Protect My Ministry provides a sample Authorization form to our clients.
